Terms of Use for Palimpsest

Palimpsest is a journaling app where you write by hand and an ancient entity living in the ink responds. No account is needed. By using the app, you represent that you are at least 18 years of age. The app processes your data as described in our Privacy Policy.

Responses in Palimpsest are generated by Artificial Intelligence. The entity is a fictional character, not a real being. Its responses may be inaccurate, unexpected, or inappropriate despite our safety measures.

Do not rely on anything the entity says for medical, legal, financial, or therapeutic advice. If you are in crisis, please contact a qualified professional or emergency service.

Palimpsest offers consumable in-app purchases ("ink refills") that provide additional prompts. A limited number of free prompts are included on first install.

Ink refills are consumable and non-refundable through the app. If you believe a purchase was made in error, you may request a refund directly from Apple. Purchased ink persists even if you use the "Forget Everything" feature to reset your journal and memories.

Your journal entries remain yours. We do not claim ownership of anything you write. By using the app, you grant us a limited license to process your entries through AI services solely for the purpose of generating the entity's responses.

We have a zero-tolerance policy for objectionable content or abusive behavior. You agree not to:

• Use the app to generate or store content that is illegal, harassing, or promotes violence
• Attempt to reverse-engineer, decompile, or extract the source code of the app
• Deliberately overload or abuse the service
• Share, redistribute, or resell access to the service

You acknowledge that these Terms are between you and kinscabin only, not with Apple Inc. kinscabin is solely responsible for the app. Apple has no obligation to provide maintenance or support for Palimpsest. Any product claims or documentation regarding the app must be directed to kinscabin.

We may update, modify, or discontinue the app or any of its features at any time. We will make reasonable efforts to preserve your purchased ink balance through updates. However, we cannot guarantee uninterrupted availability of the service.

The app is provided "as is" without warranties of any kind. To the fullest extent permitted by law, we are not liable for any damages arising from your use of the app.

Note for users in Germany: Nothing in these terms limits our liability for damages caused by gross negligence, willful misconduct, or injury to life, limb, or health. Our maximum aggregate liability shall not exceed the total amount you have paid us through in-app purchases in the twelve months preceding the claim.

These terms are governed by the laws of the Federal Republic of Germany. Any disputes arising from or relating to these terms shall be subject to the exclusive jurisdiction of the courts of Munich, Germany.

If we make meaningful changes to these terms, the updated version will be posted at this URL with a new effective date. Continued use of the app after changes are posted constitutes acceptance of the updated terms.
